Allandale Neighborhood Association – Executive Committee—Minutes

Meeting was opened by the President Tom Linehan
1)    Approve the Agenda
a.    Dan Jones moved to add an item to postpone payment on Big Red, seconded.  Discussion as to adding this to the agenda.  The vote was taken and failed 4 to 3.
b.    Motion to approve the agenda by Mary Jean Mattus, seconded.  Approved as follows
i.    Legal Summary
ii.    Legal Expenses
iii.    Legal Representation

2)    Minutes from October 25th were postponed
3)    Tom Linehan (for Treasurer Joe Reynolds) made a brief Treasurer’s report
a.    Current Balance is $9,000
b.    Amount of bills generated by Blazier, Christian is $67,194 from December 2006 through October 2007.  This does not include any November bills.
c.    ANA has paid $36,302.
Secretary Note:  The actual amount in the Treasury is actually close to $20,000 as of this date—an amendment will be added to these minutes as to the exact amount

4)    Alland McMurtry gave a presentation of the issues current in the lawsuit against the City of Austin and Lincoln Properties.
a.    Standing issue of ANA and RG4N.  Both were made good
b.   Attorney’s fees
i.    Lincoln has offered to drop the request for attorneys’ fees if ANA drops any appeal
ii.   Current Lincoln attorneys’ fees are $17,000
iii.  City did not ask for attorneys’ fees
c.    Filing an appeal
i.     Costs
1.    Filing is $500
2.    Copying is $500
ii.    We have 30 days from the filing court documents to file
iii.   If we appeal
1.    30 days to file
2.    30 days to respond
3.    30 days to answer
4.    Court will read and ask for more data
5.    Probably no hearing
6.    Decision will take about 1 year
7.    No bond is required
d.    Fees for others
i.    City of Austin is about $424,000
ii.    RG4N is $140,000
iii.    Lincoln’s costs are unknown
e.    Discussion and questions followed
i.    RG4N would probably appeal
ii.    Decision is due from the District judge on RG4N’s lawsuit the middle of December
iii.    The decision might or might not be a requirement for a public hearing
5)    Motion was made to discuss legal issues relating to the case by Allan McMurtry, seconded.  Discussion followed with no action taken
6)    Amotion was made by Allan McMurtry to hold a Special General Meeting to discuss the City of Austin/Lincoln lawsuits to be held on Thursday, November 29th.  Seconded by Laura.  Passed.
7)    The meeting adjourned by motion of  Donna Beth McCormick and seconded.  Motion passed.
